BOSTON TOWNSHIP

The township minutes are posted on our website at www.bostontownship.org and outside the fiscal office at the Boston Township Hall. Trustee meetings are the second and fourth Wednesday of the month. Zoning commission meets the second Tuesday of the month and the Board of Zoning Appeals meets the fourth Wednesday of the month.

Road Department: The trustees approved the replacement of the access door to the road garage. When not busy plowing and salting roads, the Road Department has been working on trimming overhanging branches and repairing ditches.

Zoning Updates: The Zoning Commission continues to work with Mark Majewski of Northstar Planning regarding text amendments to the Business Corridor. Currently under discussion are changes to the zoning text regarding properties in the area of Seasons Road. A hearing was held by the Board of Zoning Appeals on February 27 for EBS Construction of 5079 Akron-Cleveland Road. At that hearing EBS Construction was granted a variance to operate a distributor`s warehouse. The Zoning Commission and the trustees have both recommended two minor changes to the township`s zoning map. Two parcels, 06-00202 and 06-01033, would be changed from R (Residential) to EAD (Economic Activity District). This rezoning will be sent to the Summit County Planning Commission for their consideration. Ultimately hearings will be held by both the Zoning Commission and the trustees.

Township Meeting Date Change: We will be moving the date of our first meeting in April to Thursday, April 12 at 6:00 pm. We are moving the date so that the trustees can attend the village`s sewer meeting that will be held at the same time as our regularly scheduled meeting.

PENINSULA COUNCIL

The Peninsula Village Council met in regular session on March 12, 2018. The Mayor announced that the security cameras were in place and operational at the Service Garage. Council reappointed Bradric Bryan of Goodwin & Bryan, LLP as the Village Solicitor and Prosecutor. The Mayor stated that there is still a vacancy on the Village`s Board of Zoning Appeals. Any citizen who is interested in serving may call the Mayor`s Office for consideration.

POSTCARDS FROM PENINSULA

Want to help end gerrymandering in Ohio? On May 8 voters will have a chance to pass ISSUE 1, a bipartisan compromise that will end one-party determination of our congressional districts. Since this redistricting reform is the result of a grassroots, low budget initiative word is not getting out to voters.

Come to the library on Thursday, April 19 between 1 and 4pm to learn about ISSUE 1. Then help us address postcards to voters to let them know.

There`s something important on the ballot this May. Gel pens and postcards will be provided. Refreshments will be served.

Thank you to everyone who supported the National School Walkout, Wednesday, March 14.

I extend my deepest thanks to Boston, Peninsula and all the citizens who stood in support of Parkland students and the National School Walkout. I especially want to thank the Boston trustees for use of the parking lot, Ron Adams for clearing and salting the sidewalk, all the elected officials of both entities who stood, the police who watched over us, the many shopkeepers who posted fliers, the many, many citizens who stood in twenty odd degree coldness for seventeen minutes, and Lee Mahan, who brought her young grandson to see how to grow up to be a real citizen. To anyone I`ve missed, Thank You. This community is indeed gracious.

PENINSULA WASTEWATER INITIATIVE UPDATE

MARK YOUR CALENDAR! Wastewater Project Update and Public Input. Wednesday April 11, 2018 from 6:00PM to 8:00PM at the Boston Township Hall
We are now almost three months into the Design Engineering. Please join us Wednesday, April 11, from 6:00PM to 8:00PM, at the Boston Township Hall for a session with Stantec Consulting, who will be updating the Village on our wastewater project. Stantec will also provide an overview of the preliminary collection system layout and discuss how your property will tie into the main collection line. Stantec consultants, Gary Silcott and Dale Kocarek, will be on hand to talk with you individually to gather information on your current basement depth and sewage outtake pipe location. So if you are inclined, mosey down to your cellar before the session, measure your basement height and note at what level your sewage pipe exits the building. This information will be helpful to verify the preliminary estimated depth levels of the main collection pipes. This program is for those that live in the Wastewater Service District, or own property within the District, as Stantec will be discussing specifics of your property`s connection to the main line. But all are welcome!

FAQ`s on Sewers
As the wastewater project continues to move forward, many of you will have questions. Please watch for these FAQs to be posted on the Village website. For now, we would like to share some of the recent questions we have been receiving.

Why am I being charged a sewer fee when I have no sewer services yet?
It is not uncommon for a community to begin charging a sewer fee well before they have sewers to build a reserve for when the day comes. Unfortunately, the Village had never instituted a sewer fee and has no "nest egg" to fund preliminary or design engineering work. The current sewer fee of $15 per month per addressed property is sufficient to satisfy the initial payback terms of the Ohio Water Department Authority loan to complete the Design Engineering.

Why are the residences and businesses, being charged the same, i.e. $15 per month?
As advised by Stantec Consulting and our Village Solicitor, in instituting the initial sewer fee, Council decided that during the engineering phases, all users are receiving the same "benefit" or value. As a result, it was determined that all properties in the District must be treated equally at this point and charged the same sewer fee. The preliminary engineering report and design engineering are providing the same benefit, or value, to a resident as to a business. So for now, while we are in the engineering phases, every address will be charged the same $15 per month. Once the system is constructed, the "benefit" for a resident vs a business vs a duplex, etc. is different due to the amount of waste the user is estimated to produce. As a result, at that time, it is expected that different categories of users will be paying different sewer fee amounts based upon their estimated sewer flow pursuant to EPA guidelines. These flow estimates are referred to as "EDUs" or Equivalent Dwelling Units. EDUs will be calculated using EPA calculating charts for communities that do not have a central water system. As an example, a single-family dwelling will be one EDU, whereas a duplex will be two EDUs. EDU levels for restaurants and entertainment halls are based on max seating capacity, and EDU levels for industrial users are based on the number of employees. Libraries, churches and schools are each contained in other classifications in the EPA EDU guideline charts.

Can I refuse to pay this sewer fee?
No. In December 2017, Council passed Ordinance 24-2017 establishing Chapter 931 of our codified ordinances to establish a monthly sewer fee within the Wastewater Service District. There are provisions in this ordinance, as you will find with any municipal sewer fee, for late payment charges and property liens for delinquent accounts. Please contact the Village offices if you would like a copy of Ordinance 24-2017.

I am hoping to sell my house soon. Do I still have to pay this sewer fee?
The sewer fees will be charged quarterly, staring with the April 1 through June 30 quarter. Yes, you must make your payment each quarter. If you are in the process of or planning to sell your property, please familiarize yourself with Chapter 931, Section 931.05, Responsibility for Bills upon Sale of Property. Please contact the Village offices if you would like a copy of Chapter 931.

Last month`s YCN said we will be charged $15 per month per user. Does that mean each person in my household will be billed $15 per month?
No, each person will NOT be charged $15. The more accurate description for the fee, and as it is defined in the ordinance, is "$15 per month per addressed property containing a building in the Wastewater Service District". We apologize for any confusion the "per user" language contained in last month`s YCN may have caused.

PALM SUNDAY TO EASTER 2018

March 25 begins Holy Week with Palm Sunday of the Passion of the Lord. Masses at Mother of Sorrows Parish are Saturday, March 24, at 5:00pm; Palm Sunday at 8:30am and 11:00am. On Palm Sunday, the congregations of Peninsula United Methodist and Mother of Sorrows will lead the annual Ecumenical Blessing of Palms and the remembrance of Jesus` entrance into Jerusalem. All are invited on Palm Sunday to gather at DMT (Rt. 303 and S. Locust Street) at 10:45AM for the Service. Daily Mass is scheduled at 8:30AM on Monday and Tuesday of Holy Week, on Holy Wednesday, March 28, Mass will be at 7:15PM. There will be a Communal Penance Service on Monday, March 26, at 7:00PM in church. On March 29, Holy Thursday, Mass of the Lord`s Supper will be at 7:30PM followed by adoration of the Blessed Sacrament until 11:00PM. On Good Friday, March 30, there will be Stations of the Cross (outside, weather permitting, if not, in church) at 2:00PM. The Good Friday Liturgy will be at 3:00PM and again at 7:30PM. On Good Friday, Sacrament of Reconciliation will be available at 4:15PM to 5:15PM and 8:30PM to 9:15PM. On Holy Saturday, March 31, The Sacrament of Penance will be available at 11:30AM to 12:30PM. The Easter Food Blessing is at 1:30pm. The Easter Vigil Mass is at 7:30PM on Holy Saturday. On Easter Sunday, April 1, Masses are at 8:30AM and 11:00AM. Dear Friends and Neighbors:

Thank you for trusting me to represent you on Village Council. It`s a great and humbling honor, and I`ll try to do my best. I`m writing because there are strange and troubling things happening, and I don`t understand why. Here are just a few:

a. Why did Council enter into a contract for almost half a million dollars without doing any interviews? They didn`t even try to find a lower price, even though we won`t rent a copy machine without multiple quotes.

B. And why did Council do it at an "emergency" meeting, just before New Year`s Eve — not giving reasonable notice to everyone who wanted to participate — or even just watch?

C. And why did Council do this with no announced plan on how all of this will be paid for, except to say that "we hope we can find grant money?" What if they don`t?

D. And why are people being forced to pay a sewer tax NOW even though it`s years before they`ll see any benefit? (I was told that the money is being collected so "people will get in the habit of paying it." Do you really need to "practice" paying taxes? Everyone I know has had lots of experience with that — no more practice needed…)

e. And why did Council tax everyone the same amount? A single person living alone pays the same amount that the restaurants pay. The village solicitor says that businesses and residents could legally be taxed at different rates — but Council decided "it`s easier to charge everyone the same thing."

f. And why did Council spend $3000 to do the billing? And to sign a contract with a company in Kentucky rather than look closer to home? And to meet at an unannounced time on a Saturday morning to do it?

All I`m told, when I ask any of these questions is that "We`re moving forward with the Project."

Maybe you, as members of the community can get better answers.

I`d love to see sewer, and a system which is affordable and sustainable. I`d love to see plans that make it clear how it`s going to be done, how much it will REALLY cost, and who is going to pay for it. I`ll be the first to congratulate anyone who comes up with the plan and the money.

But — at the moment — it seems like the only reaction that happens when I ask these questions is that the people most invested in it get angry that they`ve been asked to explain — and then they go off and meet in private.
